you need to have the axle removed from the car by an expert. (an unbiased professional axle shop) you need to have the axle dissassembled and inspected piece by piece to determine cause of fault. ($$) (by an unbiased professional axle shop) you need to then take your pictures. then you need new samples of correct parts. ($$) then you need a professional report by a professional axle shop with their opinion on cause of fault written ($$)then you can file for a lawsuit. however, you cannot file for a lawsuit until the person being sued has been allowed to respond. you barking up a hell of alot of headache. I quit when my lawyer told me how much it was going to cost ME. If you're going for that public court stuff (<$5000.oo damages), then you might have a chance, but you'll still need all that professional opinion shit. the judge will also take into account the person being sued, past history (which is usually flawless (ie, no other account of broken axles))...
